REGULATION OF THE SSC.2018 STAR INN SURFBOARD COMPETITION

1. FRAMEWORK

1.1. Star inn Surfboard Competition is a joint initiative developed by Hotel Star inn Peniche (hereinafter referred to as the Hotel), Vulture Surfboards and Special Surf 78.

1.2. Hotel Star inn Peniche is explored by the company Águias do Surf – Empreendimentos Turísticos de Peniche, Lda, with headquarters at Estrada do Baleal, Hotel Star Inn Peniche, parish and municipality of Peniche, registered at the Conservatória do Registo Comercial de Peniche (Peniche Commercial Registry) under the single registration and taxpayer number 140.522.

1.3. Vulture Surfboards is a local producer of surfboards explored by Daniel Rosmaninho Pombo, with headquarters at Av. do Porto de Pesca, Lt 13, 2520-208 Peniche, registered at the Conservatória do Registo Comercial de Santarém (Santarém Commercial Registry) under the single registration and taxpayer number 779.920.

1.4. Special Surf 78 is a local surf school explored by the company Special Surf 78, Lda., with headquarters at Rua 1º de Maio, nº3, Vivenda Jesus, 2520-267 Peniche, registered at the Conservatória de Registo Comercial de Peniche (Peniche Commercial Registry) under the registration and taxpayer number 510.192.645.

1.5. The Competition aims to select twelve (12) drawings to decorate surfboards, which will be sold at the public sales space of Vulture Surfboards and a copy of which will be displayed on the Hotel facade until the end of the year two thousand and nineteen.

1.6. The Competition is open to all participants that wish to sign up for it. If there is a sufficient number of quality applications submitted by candidates residing at the Leiria municipality (local authors), then a minimum of seven (7) drawings will be chosen among local authors out of the total twelve (12) drawings to be selected at the Competition.

1.7. Vulture Surfboards shall manufacture the surfboards with the selected drawings.

1.8. Vulture Surfboards shall hold the exclusive sale of the surfboards at the public sales space of Vulture Surfboards.

1.9. The public selling price (VAT included) of surfboards will be five hundred and fifty euros (550€) for surfboards up to 6’4 inclusive (Shortboard), five hundred and seventy euros (570€) for surfboards up to 7’0 inclusive (Funboard), six hundred euros (600€) for surfboards of 7’0 up to 8’11 (Malibu) and seven hundred and fifty euros (750€) for surfboards from 9’0 inclusive (Longboard).

1.10. The authors of the drawings selected shall be awarded a voucher for a three (3) day stay at the Hotel, on a space-available basis, on half-board accommodation for two (2) people, and a fifty euro (50€) artist fee per surfboard (VAT or other taxes included) that is sold, for each one of the surfboards sold with the respective drawings.

2. OBJECTIVE

2.1 This Competition is intended to promote the identity of Peniche as a privileged destination for the practice of surf, to enhance the creative work of the local community as to how it adapts to this sport, and to support the local manufacture of surfboards, by giving them visibility through advertising and promotion on scale, as well as to award the twelve (12) winning drawings.

2.2 Each one of the winning drawings shall be applied on surfboards manufactured by Vulture Surfboards, which shall be sold on an exclusive basis at the public sales space of Vulture Surfboards, a copy of which shall be displayed on the facade of the Hotel until the end of two thousand and nineteen.

3. COMPETITION JURY

The Competition Jury shall be composed of three members, one appointed by the Hotel, another one by Vulture Surfboards and the third one by Special Surf 78.

4. CONTESTANTS

4.1 The Competition is open to all contestants who wish to take part in it, and each contestant may receive awards for two (2) drawings at the maximum.

4.2 A number of up to two hundred (200) validated applications shall be accepted.

5. ANALYSIS AND DECISION CRITERIA

Drawings submitted shall be evaluated according to the following criteria:

5.1 Residence or non-residence of authors at the municipality of Leiria;

5.2 Drawing’s contribution to the selling expectation of surfboards;

5.3 Originality

6. CLASSIFICATION OF DRAWINGS

The classification of the drawings shall be made by weighting between the Competition Jury’s vote and the result of the public vote, each one of them having the same weight of fifty percent (50%).

The public vote shall be carried out between the tenth and the thirtieth of September of two thousand and eighteen on the Facebook page of the Hotel (www.facebook.com/StarinnPeniche/), where the competing drawings shall be shown. The public vote shall be made by a “like” or “love” that each voter puts on each application. Each voter may choose more than one candidate.

7. SELECTION OF THE WINNING DRAWINGS

Drawings shall be sorted out by the descending order of classification, thus taking place an early selection of the first twelve (12) selected drawings.

If, as a result of this early selection, at least seven (7) drawings by local authors (residing at the Leiria municipality) have not been considered, these shall be selected, by descending order of classification, from among the best classified twenty-five (25) of the global list, by replacing at the early selection the worst classified non-local authors by the new drawings of local authors, selected on the basis of this criterion, until reaching seven (7) drawings by local authors, except if among the best classified twenty-five (25) of the global list there are not enough drawings for that purpose, in which case the number of winning drawings by local authors shall be reduced to the number of drawings obtained with the referred criterion, thus the total number of 12 (twelve) selected drawings being maintained.

8. AWARDS

The authors of the drawings that were selected shall be awarded a voucher for a three (3) day stay at the Hotel, on a space-available basis, on half-board accommodation for two (2) people, and a fifty euro (50€) artist fee per surfboard (VAT or other taxes included) that is sold, for each one of the surfboards sold with the respective drawings.

The amounts to be received by each one of the authors shall be estimated on the basis of the sales of the surfboards decorated with the respective drawings each quarter and shall be paid by Vulture Surfboards until the tenth working day of the month after the quarter to which they concern.

The awarded authors may opt to replace the amounts to which they are entitled by vouchers of the same amount to be used on services at the Hotel, according to its availability. In these cases, the amounts to be paid to the awarded authors shall be paid by Vulture Surfboards to the Hotel, for payment of the vouchers, which shall be handed over by Vulture Surfboards to the authors.

9. STEPS

9.1 ADVERTISING

The Hotel, Vulture Surfboards and Special Surf 78 shall advertise the Competition on their respective sites or by other means of communication, including social networks.

9.2 OFFICIAL COMMUNICATION

The official communication of both the Competition and the development of the several stages shall be made on the Facebook and Instagram pages of the Hotel.

9.3 APPLICATIONS

The request to be accepted at the Competition shall be made exclusively through the Hotel site (https://www.hotelstarinn.com/peniche/star-inn-surf-board-competition/), by completing the form made available there for that purpose, which shall be available between the first and the sixteenth of September of two thousand and eighteen.

9.4 REPLY TO THE REQUEST OF ACCEPTANCE AT THE COMPETITION

Within a period of no more than three (3) working days, the candidate shall receive, at the email provided on the form submitted, the respective candidate reference, a sample of this Regulation and the scale models which will serve as a basis for the creation of the drawing(s), thus allowing the candidate to submit drawings for surfboards measuring 6’4 1930x520mm (Shortboard), 6’8 2070x605mm (Funboard), 7’0 2100x530mm (Malibu) and 9’0 2740x580 (Longboard).

9.5 SUBMISSION OF DRAWINGS

Each candidate shall send by email, until the twenty-eighth of September of two thousand and eighteen,  to the address ssc.peniche@hotihoteis.com, the drawing(s) that he/she would like to submit to the competition in a .jpeg or .png format. This submission shall be made by indicating on the subject line (mandatory) the reference that was assigned to the candidate (ex. SSC.2018#001). The drawing(s) to be submitted shall be sent by using, as a basis for their creation, the scale models that were previously provided to the candidate by e-mail.

9.6 VALIDATION OF THE PROPOSALS

Within a period of no more than three (3) working days, the information on the validation of the drawing(s) submitted shall be sent from the e-mail ssc.peniche@hotihoteis.com to the address provided by the candidate.

The Competition Jury shall reject without further consideration the applications that:

  • Do not acknowledge Vulture Surfboards’ exclusivity on the implementation of the projects to be included in the Competition;
  • Do not give all rights of use of the winning drawings to Vulture Surfboards;
  • Do not commit to participate in all introduction sessions to the public or the media which, within the Competition scope, may be decided by Star inn Surfboard Competition;
  • Do not authorise that the authors’ personal data provided with the application is subject to processing for the purposes provided for in paragraph eleven (11) of this Regulation.

The Competition Jury also reserves the right to exclude the applications whose proposals are not in line with the criteria of analysis and decision referred to in paragraph five (5) of this Regulation.

Only the first two hundred (200) proposals validated by the Competition Jury shall be accepted at the competition.

 9.7 DISPLAY OF PROPOSALS

Upon communication to the candidates that the respective proposals were validated, they shall be displayed on the Facebook page of the Hotel (www.facebook.com/StarinnPeniche/).

9.8 DISCLOSURE OF THE WINNING DRAWINGS

The disclosure of the winning drawings shall be made as of the eighth of October of two thousand and eighteen, inclusive, by publishing the results of the Competition on the Facebook page of the Hotel (www.facebook.com/StarinnPeniche/).

9.9 DISPLAY OF THE SURFBOARDS WITH THE WINNING DRAWINGS ON THE HOTEL FACADE

The twelve (12) winning drawings shall be displayed on the Hotel facade by painting them on the surfboards currently on display on the respective facade, as of the thirtieth of November of two thousand and eighteen, or earlier, if it is possible.

Until the beginning of the surfboards’ sale, the display of the surfboards shall be enhanced by placing a Competition explanatory board by the main entrance of the Hotel.

9.10 BEGINNING OF SALE OF SURFBOARDS

The beginning of the surfboards’ sale with the winning drawings shall take place until the first of January of two thousand and nineteen.

10. CONTESTANTS’ STATEMENTS

10.1 Upon accepting to participate in the Competition, contestants expressly acknowledge Vulture Surfboards exclusivity on the implementation of the respective projects included in the competition, in particular, but without limitation, as far as the decoration of the surfboards is concerned;

10.2 Upon accepting to participate in the Competition, contestants also expressly acknowledge that, in case their respective drawing(s) win, they give all rights of use of those drawings to Vulture Surfboards;

10.3 By accepting to participate in the Competition (application), contestants commit themselves to participate in any introduction sessions to the public or the media which, within the Competition scope, may be decided by Star inn Surfboard Competition;

11. PROTECTION OF PERSONAL DATA

During the Competition processing, personal data of candidates is collected and stored, namely their name, e-mail, municipality and country of residence, among others, as well as, in the case of the winning candidates, their address and taxpayer identification number.

Collected personal data shall be processed according to the General Data Protection Regulation, and the participation in the Competition entails the knowledge and acceptance of the following:

  • Candidates accept that data supply is necessary and mandatory for purposes of processing the competition and establishing the winners;
  • Winners accept that collection of their personal data is necessary both for award delivery and tax purposes;
  • Data shall be collected and processed by Hoti – Hotéis, SGPS, S.A. (a Hoti Hotéis), the entity responsible to manage the Hotel, with headquarters at Avenida D. João II, lote 1.16.02.B, 1990-083 Lisboa, and registered at the Conservatória do Registo Comercial de Lisboa (Commercial Registry of Lisbon) under the single registration and taxpayer number 504.762.982; or by a third party appointed by the latter which is bound to comply with the General Data Protection Regulation;
  • Personal data shall be conveyed to the Hotel, Vulture Surfboards and Special Surf 78, which are also bound to comply with the General Data Protection Regulation;
  • The name of the candidates shall be subject to public announcement associated to the release of the drawings submitted at the Competition;
  • Personal data of the non-winning candidates shall be stored in an electronic file for the period of one hundred and eighty (180) days of the date of application submission;
  • Personal data of winning candidates shall be stored in an electronic file for as long as payments of awards are likely to take place and until minimum legal deadlines to store the data in question are exhausted;
  • Hoti Hotéis ensures the safety and confidentiality of data processing and ensures the possibility of access, rectification, opposition and erasure of data to candidates who wish to do so and communicate it through the e-mail dadospessoais@hotihoteis.com.

12. DOUBT CLARIFICATION

In order to clarify any doubts concerning this Competition, the e-mail ssc.peniche@hotihoteis.com shall be used.   

13. FINAL PROVISIONS

13.1 Star inn Surfboard Competition reserves the right, at any time, to introduce amendments to this Regulation, without any obligation to issue a prior notice.

13.2 In case there are no sufficient applications or the existing ones do not have the quality that the Competition Jury sees fit to ensure the success of the Competition, Star Inn Surfboard Competition reserves the right to extend the specified deadlines until the display of the winning drawings on the surfboards of the Hotel.

13.3 Upon accepting to participate in the Star inn Surfboard Competition, candidates accept full responsibility for the contents they are submitting to the Competition and declare that they are the authors of the drawings they are submitting and over which no other entity may claim copyrights. Therefore, Star inn Surfboard Competition may not be held accountable for the misuse of contents of intellectual property for which it has not been authorized.

13.4 In the case of selection of drawings which were unduly submitted by the candidates, among others, because they are not the authors, Star inn Surfboard Competition reserves the right to replace them by other applications, without the obligation to issue a prior notice.

13.5 If the winning drawings of this edition of the Star Inn Surfboard Competition continue to be commercially viable after the year of two thousand and nineteen, Star Inn Surfboard Competition reserves the right to keep them, all or just some of them, on display and for sale beyond the end of that year, and as such the authors of the drawings continue to receive the percentage specified for the sale of each of the surfboards sold with the respective drawings.

13.6 Given that Star Inn Surfboards Competition also aims to display and sell surfboards linked to the Hotel renovation project, in order to be a wealth generator to the local community, it is necessary that the partners involved in the project development, namely, the local surfboard manufacturer and the local surf school, are fully capable to meet the customers’ needs, by ensuring the manufacturing quality of the surfboards, the capacity to sell them and their prompt delivery. In order to ensure compliance with these objectives, the Hotel reserves the right to replace its project partners, due to the repeated failure of the above-mentioned tasks, in which case the rights and obligations resulting from this Competition shall be transferred to the new partners.

13.7 The participation in the Competition entails the knowledge and full and unconditional acceptance of the terms and conditions provided for in this Regulation.
